Elite Business Growth Advisors LLC (doing business as SmartMoney Financial) respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) (“DMCA”). It is our policy to respond to valid notices of alleged copyright infringement and to remove or disable access to infringing material.
Filing a DMCA Takedown Notice
If you believe that content on the Site infringes your copyright, send a written notice to our designated agent at akoshner@gmail.com with the subject line “DMCA Notice.” To be effective under the DMCA, your notice must include:
- Your physical or electronic signature;
- Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works);
- Identification of the material you claim is infringing, with enough information (such as the URL) for us to locate it;
- Your contact information: name, address, telephone number and email address;
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent or the law;
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
Our Response
Upon receipt of a valid notice we will promptly remove or disable access to the material identified and, where applicable, notify the user who posted it. We may terminate the accounts of repeat infringers.
Counter-Notification
If you believe material you posted was removed by mistake or misidentification, you may send a counter-notice to akoshner@gmail.com containing: your physical or electronic signature; identification of the removed material and its former location; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., any judicial district in which we may be found) and that you will accept service of process from the person who filed the original notice. If we receive a valid counter-notice, we may restore the material in 10–14 business days unless the original complainant files a court action.
Misrepresentation
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages.
